Legislation

If there is a conflict which cannot be resolved on a good will basis and all means have been exhausted to reach agreement, or if you have irreparable damages incurred as a result of any wrongful actions of some government authorities, or if you need a court decision to have a formal proof of some fact, then you have a clear case of court settlement.

In this case, you need to have not just qualified representation of your interests, but also in addition to that you have:
  • to submit to the court all possible documents made and executed on a professional level to give the court an opportunity for formulating a formal substantiated decision in your favour allowing for a possibility to defend or contest the court decision in judiciary institutions of further instances (appellate, cassation, supervisory);
  • to organise acquisition and filing of proof, evidence on a case;
  • prior to the beginning of the proceedings to obtain:

    • a conclusion on the strong and weak points of your position in court;
    • a plan of using the strong points and of strengthening the weak points;
    • as far as possible, a full scope of information on the opposite party's position in the case and the evidence, arguments, proof it has at its disposal; if possible, to conduct negotiations and arrange for communication with its representatives and lawyers (if this is not contrary to your position);
    • a plan for neutralising the strong points and taking advantage of the weak points of your opponent;
    • a forecast of what may await you throughout the court proceedings;
    • an analysis of a variety of possible actions;
    • instructions on how to respond to unexpected situations in the process;
    • interrogation from the viewpoint of the opposite party's lawyers;
    • qualified advice of how to reduce legal expenses.

WG follows the rule that the WG expert team work should be transparent for the customer; the customer is a participant enjoying full rights in the process of working on a case and may take an active part in creating and defining more precisely the position on the case. Such an attitude to the customer allows to create and establish effective interaction, helps the customer develop a conscious position, build up confidence in his actions in the course of the court proceedings, and as a result, such co-operation with lawyers in the process is often as convincing for the court as any evidence provided by the parties.

WG sets forth the following requirements to its experts in the process. They are required:
  • to be able to create a constructive environment in court;
  • to actively use arbitrage/court procedure instruments allowing to influence the proceedings progress in the interests of the client;
  • to get the opposite party involved in negotiations for the purpose of obtaining as much information as possible about any changes in its position, evidence, proof, arguments as well as for seeking ways of a possible settlement of the conflict (of course, with the exception of those cases when this does not agree with the position adopted).
WG experts have gained a great deal of experience in conducting highly complex arbitration cases in courts of all (first, apellate, cassation and supervisory) instances. The technology which WG employs in its work on every case allows to achieve the quality of services which may not be attained if a different approach is used. Professional team work in co-operation with the client makes it possible to find the most effective solutions in the most complicated and seemingly hopeless situations.

You will become a participant in the process whose objective is an active and efficient search for a solution to benefit the customer with regard to all the aspects of the case. In this real life process it happens that a solution found is beyond all expectation.

The WG experts think that our best achievement is your assurance of success and security.
